Dyfs is "Helping" us

Soon we were contacted by Stacy Weigondt,our new social worker. She was told the entire story of what was happening, of course leaving out the fact that I was forced into lying about drug use in order to get Dyfs help.We now had in home counseling for the family. I welcomed it. At some level it felt good telling them all of this,and the police investigation couldn't be going any slower.Ashley and Jesse continued though.Soon the police detective ib charge of the investigation called and asked if I could bring Ashley in for an interview, He stated that he had already had a videotaped interview with Jesse and needed Ashley's interview before presenting it to the prosecutor. I of course had her down there that day. I had also submitted my computer to the computer crimes unit for them to examine for anything inappropriate on that between Jesse and Ashley.I was so happy to hear that it was almost concluded and this man was about to be prosecuted.Sometime during the past couple months Ashley had not come home Again until
the next morning.She was fifteen now. Their behavior was becoming blatant and in my face with an attitude of"you cant do anything about it!" Out of complete desperation and not knowing what else to do I had called Dyfs and asked them to put Ashley into foster care as I couldn't protect her from this man. The worker told me that if I did that it would be considered abandonment and I would b prosecuted. I was not the one who belonged in jail so of course I decided not to go that route.
So we went to see Det. Huber. He interviewed Ashley. He said both Ashley and Jesse were very frank with him and denied nothing.He also said On top of Jesses videotaped confession, he had obtained a receipt from a motel room where they had both stayed one night when she didn't come home. He said he had a good solid case with solid evidence against Jesse and we would be able to charge him with Salutatory rape,endangering the welfare of a child and contributing to the delinquency of a minor. He reassured me and said he would get back to me as soon as he presented it to the prosecutor. After what seemed like an eternity he called me to tell me that he had in fact presented all of his investigation and evidence to the prosecutor.He then continued to tell me that the prosecutor was refusing to prosecute with the stated reason that Ashley was willingly involved in this relationship. Now as anyone reading this realizes, the reason these laws are in place with specific age limits is because at her age she was not legally able to consent to any of this.This is outrageous!! I called the prosecutors office myself and had them tell me that indeed that was the decision, that even though Ashley was well under the age of consent and there was actually more than ten years difference in their ages, and yes according to the laws of the state of New Jersey this man was breaking the law, that because she was consenting(which legally she cannot do) they have decided that it would be to much time money and effort spent to prosecute him.They went on to remind me that "Its not like he is a teacher or a person of authority over her and it will take alot of effort to prosecute him"Even though they had a videotaped confession along with a hotel reciept that Jesse didn't deny was his and Ashley's I couldn't believe what I was hearing! How could the not prosecute a crime against a child? So what if the guy wasnt a teacher! He was a now twenty six year old pervert who defiled my daughter and is continuing to do so, abused her, caused her to be truant from school, supplied her with drugs(I found out later) and beat her(I also found out later) I and det.Huber were both livid!They said they weren't going to prosecute and nothing I said or did was going to change their mind!! So I went home and my daughter Beth helped me write a letter to the State attorney generals office. They wrote us a letter back saying they would investigate the matter and get back to us at the conclusion.(now I need you to remember the chain of command here, The AG is above the prosecutor and is the next step up in resolution in such a matter, I didn't realize at that time what an incredible conflict of interest that is in this case but read on and later you will understand)
Now lest we forget I have Dyfs involved to try and help.I contacted Stacy Weigondt and told her the news.She assured me that she was going to speak to all of the appropriate people and see what can be done to change the prosecutors mind even if she had to "Go over his head" I didn't realize what that meant or who she was planning to speak to, but I was happy she agreed that was insane and not right! I aso told her I was drafting and sending a letter to the AGs office and she agreed that that was the next step for me to take. well long story short here, she spoke to her people and informed me that her"people" couldn't do anything,and that it was really up to the prosecutor weather or not to prosecute.She looked at me and said Mrs Watson you need to fininh your drug counseling with AGAPE(I had been moving slowly on that for fear of them closing the case because Stacy told me a few times already that as soon as I finished that,she could close the case.And I knew that all drug screens were negative and that's probably why Stacy wasn't pushing the issue, by this time she realized why she was here...at least that's what I thought)The next time she came to visit,she said to me "Mrs Watson, there is nothing that can be done if the prosecutor wont prosecute and you and your husband are going to have to deal with it and move on!"She then turned to my daughter and announced "And you young lady, well we are just going to have to make an appointment with family planning so you dont get pregnant!" I stood up and yelled at her"You will do no such thing! I do not give my consent for this man to touch my daughter and you taking her to family planning is like giving him a licence to abuse my daughter worry free!!How dare you stand in my living room and say such a thing to my minor daughter!You have no right"She said "well the prosecutor not prosecuting is telling the two of them just that and you dont want her to get pregnant on top of that do you?I asked her to please leave,because at that point she was not protecting my daughter at all.
Now I have to go back to my daughter Moe, Remember the pregnant one? you have to understand her story to see how this all comes together and allows the state of New Jersey to LEGALLY take my grandson and sell him into adoption(I say sell, because DYFS gets approximatly $7,000 for each child they can mill out to adoptive parents)Next Blog will be Moe's story
